Mortgage Electronic Registration Systems, commonly known as MERS, were left in charge of recording and verifying signatures. MERS is an American privately held company that operates an electronic registry designed to track servicing rights and ownership of mortgage loans in the United States. As of 2007, MERS registered about two-thirds of all home loans in the US. By 2008, MERS were deemed unreliable and had been involved in countless lawsuits. Lending companies such as Wells Fargo, Bank of America and Chase, who bought the notes through these faulty transactions, discovered that they were unable to foreclose without physical possession of the original mortgage documents. In response to this, they began to implement the 'robo-signing' scandal.Banks have been under investigation since 2010 for their part in the robo-signing' scandal, which resulted in countless homeowners losing their homes without merit. After the scandal came to light, the banks promised that they would no longer engage in this fraudulent practice, however, as recently as July 2011, it was revealed that mortgage 'robo-signing' was not only continuing but still going strong!As a result of this continuing scandal, lawmakers called for hearings and pushed for greater oversight on banks. This led to all 50 State Attorney Generals filing lawsuits against the nation’s top five banks, including Bank of America, Chase, Ally Financial, and CitiMortgage. During the infamous bailout, State Prosecutors and the United States government offered a settlement deal of $26 billion dollars. To date, this is the largest settlement deal in the history of our country!Following the 'robo-signing' scandal, many Americans were wrongfully forced from their homes, and their loans have become invalid.
