bad pool remodel

On February 2016 I hired Roger Jones to remodel our pool. He did a nice job replacing the coping rocks, re-tiling and re-plastering the pool. During the start up phase he used a process of raising the acid level in the water for the first 4-5 days. In order to protect the pool pumping equipment from the high acid level, he placed a portable recirculation pump on the bottom of the pool. This pump left rust stains in the plaster on the bottom of the pool. Roger promised to fix that but asked that I wait until the water temperature warms up. I had to ask him a number of times to do this and he finally got around to it in June. His first attempt to remove the rust spots was unsuccessful. He then brought in his plaster subcontractor (Royal Pool Plastering) and they used acid and sanding to remove the stains. At first that procedure seemed to work. About 1-2 weeks later a very large blotch (10' x 15')appeared in the exact area where they had used the acid to remove the rust spots. I called Roger Jones and asked him to come over and take a look at the spot and he became very belligerant and argumentative. After cooling down he finally came over and looked at the huge blotch and agreed to have his plaster subcontractor come back out and try pressure washing the blotch. It didn't have any effect. He then told me that the blotch was my fault because he claimed that I had overchlorinated the pool and used inferior chlorine tablets (purchased at Costco). He told me that they would have to drain the pool, acid etch it, polish it and refill it and THAT I WOULD HAVE TO PAY FOR IT! I had already paid him $17,700 for the job.

I have contacted numerous other pool contractors and the company that provided the plaster (SGM-durazzo) and all of them say that Roger Jones should never have put the pump directly on the new plaster surface in the first place and the assertion that the Chlorine tablets could account for this huge blotch is nonsense. The huge blotch is the exact area where the acid was used.
